Terms of Use

These Terms of Use govern your access to Botalker at www.botalker.com and its AI chat and writing features (the "Service"). The Service is operated by NEROVIA DIGITAL LTD ("we", "us" or "our"). By using the Service, you agree to these terms. If you do not agree, stop using the Service.

Eligibility and accounts

You must be legally able to enter into these terms. If you have not reached the age of legal majority, you may use the Service only where local law permits and with a parent or guardian's permission. Some features require Google sign-in. Provide accurate account information, protect access to your account and tell us if you suspect unauthorised use.

Using the Service

You may use the Service for lawful purposes in accordance with these terms and the rights of others. You must not:

• Use the Service to commit fraud, facilitate harm, harass others or distribute unlawful content.
• Infringe intellectual property, privacy or other legal rights, or submit information you are not entitled to use.
• Attempt to access another user's account or data, bypass security or usage limits, or interfere with the Service.
• Introduce malicious code or use automated requests that disrupt the Service.
• Misrepresent AI responses as verified facts or impersonate another person or organisation.

AI responses

Botalker generates responses using artificial intelligence. AI roles are simulated characters, and responses may be inaccurate, incomplete, outdated or inappropriate. Review responses before relying on or sharing them. The Service does not provide professional medical, legal, financial or other regulated advice, and should not be used for emergencies.

Similar responses may be generated for different users. We do not guarantee that a response is unique, accurate or suitable for a particular purpose. You are responsible for checking the rights and permissions needed for your intended use.

Your content and our materials

You retain any rights you hold in the content you submit. You give us permission to process that content as necessary to operate the Service, including transmitting it for AI processing, generating responses and maintaining conversation features, subject to the Privacy Policy and applicable law.

Botalker's branding, software, design and other website materials remain the property of their respective owners. These terms give you permission to use the Service; they do not transfer ownership of those materials or grant rights in third-party content.

Privacy and third-party services

Our Privacy Policy explains the processing of account details, conversations and website data. Do not submit sensitive or confidential information unless you are entitled to do so and understand how it will be processed. Google sign-in and links to external websites involve third-party services with their own terms and privacy practices.

Availability and account restrictions

Features may change or be unavailable because of maintenance, technical issues or other operational needs. We may restrict or suspend access where reasonably necessary to address misuse, security risks, legal requirements or a material breach of these terms. Where appropriate and legally permitted, we will explain the restriction and how to contact us about it.

You may stop using the Service at any time. To request deletion of your account or personal data, email [email protected]. Signing out does not delete server records.

Disclaimers and responsibility

To the extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of uninterrupted availability, accuracy or fitness for a particular purpose. We are not responsible for losses caused by reliance on AI responses where such responsibility may lawfully be excluded.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, or removes mandatory consumer rights or remedies.

Governing law and disputes

These terms are governed by the laws of the Republic of Cyprus. If you are a consumer, you retain the protection of mandatory laws that apply in your country of residence, and any right to bring proceedings before a court available to you under applicable law. Contact us first if you would like us to help resolve a concern.

Changes to these terms

We may revise these terms to reflect changes to the Service or legal requirements. The date above identifies the latest version. Where required, we will give notice of material changes and obtain your agreement before they apply. If you do not accept revised terms, stop using the Service.
